If you have been injured in a traffic accident, compensation is not set by guesswork: it is calculated with the scale in Spanish Law 35/2015. The problem is that the figure depends on how your injuries are described, how long recovery took and what after-effects you are left with. And the first description is usually made by the insurer’s doctor.

What the compensation is made up of
- Temporary injuries: each day from the accident until recovery or stabilisation is paid. It is worth more if the day was spent in hospital, on sick leave or with significant limitations.
- After-effects: what remains for good (pain, loss of movement, scars) is valued in points under the scale, and the value of each point depends on age.
- Aesthetic damage: scars and other visible changes have their own valuation.
- Expenses: medical care, physiotherapy, travel, prostheses or adaptations.
- Loss of earnings: what you stop earning because of the injuries, especially if they prevent you from working.
Where insurers usually cut
- Fewer recovery days than the real ones, or sick leave days counted as days without limitation.
- After-effects not recognised or valued with fewer points than they deserve.
- Whiplash: the scale requires a conclusive medical report to compensate after-effects. Without it, the insurer usually denies them.
- Loss of earnings miscalculated for the self-employed or for workers with variable income.
What to do
- Go to A&E the same day or as soon as possible. A late medical report is the first argument used to deny the link with the accident.
- Complete all medical follow-up and physiotherapy, and keep reports, tests and invoices.
- Review the reasoned offer: the insurer must make you a reasoned offer. If you do not agree, do not accept it without checking it.
- Do not wait: the general time limit to claim is one year, which for injuries starts running from medical discharge.
Why an expert report
The medical expert report values your injuries with the same scale the insurer uses, but with all your medical reports and its own examination. It lets you challenge the offer with facts and, if there is no agreement, take the claim to court. If there is a lawsuit, we defend the report before the judge at the ratification hearing.
Personal injury valuation across the province of Cádiz
We handle cases in Cádiz and in towns such as Sotogrande, Alcaidesa or Jerez de la Frontera. We review the A&E, hospital and physiotherapy reports and, if needed, the examination is carried out by a collaborating medical specialist. If there is a lawsuit, the report is filed with the courts of Cádiz or of the relevant judicial district.
How we work
Send us the medical reports, the A&E report and the insurer’s offer, if you already have it by email or WhatsApp. We review it and send you a fixed, no-obligation quote, replying the same day.
